\nWilliam O\u00e2\u20ac\u2122Neill found out that perhaps this hamlet\u00e2\u20ac\u2122s most famous resident \u00e2\u20ac\u201d lifestyle guru Martha Stewart \u00e2\u20ac\u201d wanted the rights to its name.<\/p>\n
\u00e2\u20ac\u0153It didn\u00e2\u20ac\u2122t occur to us that you could trademark the name of our town, that you could come in and be a relatively new member of the community and take the name of the town for your use,\u00e2\u20ac\u009d said O\u00e2\u20ac\u2122Neill, a 10-year resident and co-president of the Katonah Village Improvement Society.<\/p>\n
Stewart filed six trademark applications in October 2012. O\u00e2\u20ac\u2122Neill said a town attorney read of the filing in a trademark publication in December 2013, near the end of a comment period.<\/p>\n
Local residents were granted a few months\u00e2\u20ac\u2122 extension to oppose the filing by Martha Stewart Omnimedia.<\/p>\n
The company dropped applications for some products, concerning mostly flooring, rugs and wallpaper uses, but still is seeking to trademark \u00e2\u20ac\u0153Katonah\u00e2\u20ac\u009d for paints, lightings, closet organizer kits and window accessories and furniture.<\/p>\n
The trademark application would extend to Stewart\u00e2\u20ac\u2122s Katonah brand from Bernhardt Furniture, said Diana Pearson, a spokeswoman for the Martha Stewart Omnimedia.<\/p>\n
Pearson said use of the name is in tribute to the region.<\/p>\n
\u00e2\u20ac\u0153Martha Stewart\u00e2\u20ac\u2122s homes and surroundings serve as inspiration for many of our products including Martha Stewart furniture with Bernhardt. In naming a particular line for Katonah we are paying homage to this beautiful region,\u00e2\u20ac\u009d Pearson said.<\/p>\n
Bernhardt officials could not be reached for comment.<\/p>\n
O\u00e2\u20ac\u2122Neill said some residents worry that Stewart could enforce trademark rights against local businesses or public service agencies or prevent new businesses from using the name in association with products on which she already has a trademark.<\/p>\n
\u00e2\u20ac\u0153Her company has said that this is an honor to Katonah. I haven\u00e2\u20ac\u2122t spoken to anyone in Katonah who feels honored by this. I don\u00e2\u20ac\u2122t feel honored by this,\u00e2\u20ac\u009d O\u00e2\u20ac\u2122Neill said. \u00e2\u20ac\u0153This town has a limited reputation, broad use of name will overwhelm the reputation. This is a little Victorian town, a hamlet in the town of Bedford.\u00e2\u20ac\u009d\u00c2\u00a0<\/p>\n
O\u00e2\u20ac\u2122Neill said the residents plant to contact Stewart\u00e2\u20ac\u2122s company.<\/p>\n
